1. Scope
This policy applies to information we collect through the Site, through our booking and scheduling tools, during consultations and lessons, and through email or other communications with us. It does not apply to third-party websites or services we don't control, even if we link to them or use them to deliver our services. Their privacy practices are governed by their own policies.
2. Information we collect
Information you provide to us
When you reserve a consultation, sign up for lessons, or contact us, you may provide:
- Contact and identity information — such as your name, email address, and (if you provide it) phone number.
- Scheduling information — the date and time you select, your time zone, and related booking details.
- Information about your musical background and goals — such as your instrument, experience level, and what you'd like to work on, which you may share when booking or during a consultation.
- Information about a student you enroll — if you are a parent or guardian booking on behalf of a minor, the information you provide about that student.
- Communications — the contents of messages, emails, and forms you send us.
- Lesson recordings — as described in Section 7, we record lessons as a standard part of our lesson packages.
- Payment information — if you purchase lessons, payment is processed by Stripe, our third-party payment provider. We do not collect or store your full card number. We may receive limited transaction details, such as confirmation of payment.
Information collected automatically
When you visit the Site, we and our service providers may automatically collect:
- Device and usage data — such as your IP address, browser type, device type, operating system, referring pages, pages viewed, and the dates and times of your visits.
- Cookies and similar technologies — as described in Section 4.
3. How we use information
We use the information we collect to:
- Schedule, confirm, and provide consultations and lessons;
- Respond to your inquiries and communicate with you about your bookings and account;
- Prepare a personalized starter plan or lesson recommendations;
- Provide you with recordings of your lessons as practice videos, and support the safety of students and the instructor (see Section 7);
- Process payments and keep records of transactions;
- Send you administrative messages (such as confirmations, reminders, and changes to our terms or policies);
- Send you marketing or promotional messages about our services, where permitted — you can opt out at any time (see Section 11);
- Operate, maintain, secure, and improve the Site and our services;
- Detect, prevent, and address fraud, abuse, or technical issues; and
- Comply with our legal obligations and enforce our terms.
4. Cookies & tracking technologies
Cookies are small files stored on your device. We use cookies and similar technologies to keep the Site functioning, remember your preferences, and understand how the Site is used. We may use:
- Essential cookies, which are necessary for the Site and booking tools to work; and
- Analytics and site-improvement tools, which may include AI-assisted tools, to understand how visitors use the Site and to help us maintain, design, and improve it. We use this information to understand our own audience, not to serve you targeted advertising.
Most browsers let you refuse or delete cookies through their settings. If you disable certain cookies, some parts of the Site may not work as intended.
5. How we share information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only in these limited circumstances:
- Service providers. We share information with vendors who perform services on our behalf — for example, our scheduling platform, video-conferencing provider, payment processor, and website hosting, analytics, and design tools. These providers may only use the information to perform services for us.
- Legal and safety reasons. We may disclose information if required by law, subpoena, or legal process, or if we believe in good faith that disclosure is necessary to protect our rights, your safety or the safety of others, investigate fraud, or respond to a government request.
- Business transfers. If Open Notes is involved in a merger, acquisition, sale of assets, or similar transaction, information may be transferred as part of that transaction.
- With your consent. We may share information for other purposes with your permission.
6. Third-party services
We rely on third-party tools to operate our business, including:
- Calendly — for scheduling and booking;
- Zoom — for online consultations and lessons, including the recording of lessons (see Section 7);
- Stripe — for payment processing; and
- website hosting, analytics, and design tools, which may include AI-assisted tools.
When you use these tools — for example, when you book through our Calendly page or join a session on Zoom — the provider may collect information directly from you under its own privacy policy. We encourage you to review the privacy policies of Calendly, Zoom, and Stripe.
7. Video sessions & lesson recordings
Consultations and lessons are conducted online over Zoom, and you may be asked to turn your camera on.
Recording of lessons. As a standard part of our lesson packages, we record lessons. We do this for two reasons: (1) safety and accountability — recordings help protect both students and the instructor, which is especially important for lessons with minors; and (2) practice — recordings are made available to you as practice videos so you can review your lesson.
How we handle recordings. Lesson recordings are stored securely, and access is limited to the instructor and to you (or, for a minor, the student's parent or guardian). We do not share recordings with any third party, and we do not use them for any other purpose — such as promotion or training — unless we ask you and obtain your explicit permission first. You may ask us to delete a recording, subject to any records we need to keep for legitimate business or safety reasons.
Consent. Because we record lessons, your enrollment and participation indicate your consent to being recorded. For a student under 18, the parent or guardian who enrolls the student consents on the student's behalf. If you do not consent to recording, we will not be able to provide lessons under our current packages — please contact us to discuss options. The free introductory consultation is not routinely recorded; if we ever wish to record one, we will tell you first and ask for your consent.
8. Data retention
We keep personal information for as long as needed to provide our services, maintain business and financial records, resolve disputes, and comply with our legal obligations. Lesson recordings are retained so that you can access your practice videos, and we will delete them at your request, subject to any records we must keep for legitimate business or safety reasons. When information is no longer needed, we take reasonable steps to delete it or de-identify it. You may request deletion of your information as described in Section 11.
9. Data security
We take reasonable administrative, technical, and organizational measures designed to protect your information, including lesson recordings. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping any account credentials confidential.
10. Children's privacy
Music instruction is often provided to children, and we welcome young students — but our Site and booking tools are intended to be used by adults. If a student is under 18, a parent or legal guardian must make the booking, provide any personal information, and agree to this policy and our Terms of Service on the student's behalf. We ask that a parent or guardian be present or nearby during lessons for younger students.
As described in Section 7, lessons are recorded in part to help protect younger students, and a parent or guardian has access to their own child's lesson recordings and may request their deletion.
We do not knowingly collect personal information directly from children under 13 without verifiable parental consent, consistent with the Children's Online Privacy Protection Act (COPPA). If you believe a child under 13 has provided us personal information without parental consent, please contact us at hello@opennotes.studio and we will take reasonable steps to delete it.
11. Your privacy rights
Depending on where you live, you may have some or all of the following rights regarding your personal information:
- Access — request confirmation of whether we process your information and a copy of it;
- Correction — request that we correct inaccurate information;
- Deletion — request that we delete your information;
- Portability — request a copy of certain information in a portable format;
- Opt out — opt out of marketing communications, and opt out of any "sale" or "sharing" of personal information (note: we do not sell or share personal information as those terms are commonly defined).
Marketing opt-out
You can unsubscribe from marketing emails at any time by using the unsubscribe link in the email or by contacting us. We may still send you non-promotional messages related to your bookings or account.
California residents
If you are a California resident, the California Consumer Privacy Act (as amended by the CPRA) gives you rights to know, access, correct, and delete personal information, and to opt out of the sale or sharing of personal information. We will not discriminate against you for exercising these rights. As noted above, we do not sell or share personal information for cross-context behavioral advertising.
Residents of other states
Residents of states with comprehensive consumer privacy laws — including, for example, Connecticut, Virginia, Colorado, and others — may have similar rights to access, correct, delete, and obtain a copy of their personal information, and to opt out of certain processing. To exercise any of these rights, contact us using the details in Section 15. We may need to verify your identity before responding, and you may designate an authorized agent to make a request on your behalf where the law allows.
12. International users
Open Notes is based in the United States, and we operate the Site and Services from the United States. Because lessons are delivered online, you may access them from other states or countries. If you access the Services from outside the United States, please be aware that your information will be processed and stored in the United States, where data-protection laws may differ from those in your location. By using the Services, you consent to this processing.
13. Do Not Track
Some browsers offer a "Do Not Track" signal. Because there is no common industry standard for how to respond to these signals, our Site does not currently respond to them differently.
14. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Site or our services after an update means you accept the revised policy.
